For a dispute involving loss of or damage to your household goods, or a dispute over the charges, of $10,000 or less, Hermes Moving LLC will submit to neutral, binding arbitration at your election. For amounts over $10,000, arbitration is available when both parties agree in writing. Arbitration is optional — you are not required to arbitrate and may instead pursue your claim in court, except where you have elected binding arbitration.
Arbitration is decided by a neutral, independent third-party arbitrator, generally on written submissions, based on governing U.S. federal law. The program is designed to give neither party any special advantage. A decision by the arbitrator may be binding and may not be appealed in a court of law. The program's rules, filing procedures, deadlines, and fees are established by the Arbitration Shield Program and are provided to you on request.
Each party is responsible for its own expenses and, as set by the program, a share of the arbitrator's fee and any filing fee. You will not be charged more than one-half of the cost of instituting the proceeding. Full cost details are contained in the program rules, furnished on request.
